Résumé

In this article, the author carries out a double examination of competition relations linked to the evolution of ongoing conflicts but also with regard to the initiatives envisaged in order to anticipate them. Through a retrospective analysis, the institutions highlight several trends: reaffirmation of the requirement of freedom of competition by the European Union Court of Justice on the one hand (Case C-179/16) and the Competition Authority on the other hand (Decision No 17-D-25 of 20 December 2017). Also, the requirement of fair competition could be reaffirmed in cases concerning the transfer of documents containing confidential information (Com., 13 September 2017) and concerning the copying of a competing product (Com. 25 September 2017). According to the author, several improvements can be considered, firstly concerning the functioning of competition in the pharmaceutical and medical biology sectors (in particular as regards the distribution chain of the medicinal product and price fixing). Regarding to the very common practice of mergers in the pharmaceutical sector, the role of the institutions is crucial, with the European Commission on the one hand and the Competition Authority on the other.
Dans cet article, l’auteur réalise un double examen des rapports de concurrence au regard de l’évolution des conflits en cours mais également au regard des initiatives envisagées afin d’anticiper ces derniers. A travers une analyse rétrospective, il est possible de mettre en avant plusieurs tendances de la part des institutions : réaffirmation de l’exigence de liberté de la concurrence par la Cour de justice de l’Union européenne d’une part (affaire C-179/16) et l’Autorité de la concurrence d’autre part (décision n°17-D-25 du 20 décembre 2017). Egalement, l’exigence de la loyauté de la concurrence a pu être réaffirmé dans des affaires relatives au transfert de documents contenant des informations confidentielles (Com., 13 septembre 2017) et relatif à la copie d’un produit concurrent (Com. 25 septembre 2017). Plusieurs améliorations peuvent être envisagée selon l’auteur concernant, en premier lieu, le fonctionnement de la concurrence dans le secteur du médicament et de la biologie médicale (notamment en ce qui concerne la chaîne de distribution du médicament et la fixation du prix). En ce qui concerne la pratique très courante des concentrations dans le secteur pharmaceutique, le rôle des institutions est capital avec d’un côté la Commission de l’Union européenne et de l’autre l’Autorité de la concurrence.
